{"id":510,"date":"2017-07-03T09:16:24","date_gmt":"2017-07-03T09:16:24","guid":{"rendered":"https:\/\/www.bip.cw\/our-services\/patent\/"},"modified":"2025-04-01T20:20:37","modified_gmt":"2025-04-01T20:20:37","slug":"patent","status":"publish","type":"bip_services","link":"https:\/\/www.bip.cw\/nl\/our-services\/patent\/","title":{"rendered":"Octrooi"},"content":{"rendered":"<h3>Octrooirechten geven de uitvinder exclusieve rechten om<\/h3>\n<ul>\n<li>erkend te worden als de schepper van de uitvinding (bekroonde erkenning)<\/li>\n<li>rechtsgedingen tegen concurrenten aan te spannen<\/li>\n<li>de uitvinding vrijelijk te exploiteren of te commercialiseren<\/li>\n<\/ul>\n<h3>Octrooibescherming vereist drie hoofdcomponenten voor iedere uitvinding:<\/h3>\n<ol>\n<li>De uitvinding is <strong>nieuw<\/strong> en kan in het bedrijfsleven toegepast worden<\/li>\n<li>De uitvinding is <strong>geen gewoon<\/strong> resultaat van uitvinderswerk<\/li>\n<li>De uitvinding is <strong>van toepassing<\/strong> op het desbetreffend gebied van nijverheid<\/li>\n<\/ol>\n<p>De Rijksoctrooiwet 1995 is de wet die van toepassing is op Cura\u00e7ao. Een octrooi dat onder deze wet is toegekend, heeft geldigheid zowel in Nederland als in Cura\u00e7ao, Sint Maarten en de BES eilanden. Octrooiaanvragen worden in Nederland aan het Octrooi Centrum in Den Haag geadministreerd. Het octrooi wordt door de regering van het Koninkrijk der Nederlanden aan de octrooihouder toegekend.<\/p>\n<p><strong>\u00a0<\/strong><strong>Bescherming<\/strong>\u00a0wordt dus verleend voor Cura\u00e7ao, St. Maarten, Nederland en de eilanden van Caribisch Nederland (BES: Bonaire, St. Eustatius, Saba).<\/p>\n<h3>De rol van het Bureau voor de Intellectuele Eigendom van Cura\u00e7ao<\/h3>\n<p>Octrooiaanvragen kunnen bij het Bureau voor de Intellectuele Eigendom van Cura\u00e7ao ingediend worden. Burgers van Curacao kunnen ook <strong>octrooibescherming<\/strong> vragen door gebruik te maken van het\u00a0<a href=\"http:\/\/www.epo.org\/applying.html\">Europees Octrooiverdrag<\/a><strong>.\u00a0<\/strong>Hierdoor is het mogelijk octrooibescherming te verkrijgen door middel van \u00e9\u00e9n aanvraag in verschillende Europese landen, middels de nationale wetgeving van de respectievelijke Europese landen dit lid zijn van dit verdrag..<\/p>\n<p><strong>TIP:\u00a0<\/strong>v\u00f3\u00f3r de octrooiaanvraag, doe onderzoek in gegevensbestanden om authenticiteit te bevestiging bij bijvoorbeeld <a href=\"https:\/\/worldwide.espacenet.com\/\"><strong>EPO<\/strong><\/a>&#8211;<\/p>\n<h3>Standaardprocedure voor octrooiaanvragen bij het Bureau voor de Intellectuele Eigendom van Cura\u00e7ao<\/h3>\n<p>Ter verkrijging van een octrooi, dien drie (3) kopie\u00ebn van het aanvraagformulier in.
